DEFECTIVE MEDICAL DEVICE OR DANGEROUS DRUG CLAIMS

No doubt you’ve seen TV ads and internet ads for victims of a defective medical device or a dangerous drug. These kind of cases fall into the legal category of a Mass Tort Action. They are like a class action lawsuit but each claim is individually presented. These types of claims and cases are complex and can take years to bring to a settlement. Adding to the confusion for clients is the fact that these claims and cases are often prosecuted in a venue or jurisdiction in another State. Having a local lawyer who understands how these claims work and how to locate the most favorable jurisdiction for the claim can make a big difference in the compensation recovered. Cases we are currently reviewing:

Hernia Mesh        

The defective hernia mesh devices can cause internal injuries and/or health complications. The hernia mesh recalls and lawsuits include three hernia mesh product lines: Kugel Mesh, Ethicon Physiomesh, and Atrium C-Cur mesh. The most common injuries linked to the use of defective hernia mesh products include:

  • Internal infections and pain
  • Bowel obstruction
  • Mesh detachment and migration
  • Puncture of adjacent tissue/organs
  • Fistula formation
  • Abscess formation
  • Adhesion to other organs or tissue from scar tissue formation

If you have suffered any of these injuries, you may be able to receive financial compensation from the mesh manufacturer.  Claims have been consolidated into an MDL Class Action in Ohio .             

Phillips DreamStation CPAP

On June 14, 2021, Philips publicly announced a mass safety recall of 14 models of CPAP and BiPAP breathing machines, including the DreamStation line.  According to Philips, the 2021 CPAP recall was prompted by the discovery that the PE-PUR sound foam in the machines may break down and get inhaled or ingested by users. The PE-PUR foam contains volatile organic compounds (“VOCs”) that are carcinogenic and toxic to internal organs.

Anyone who used one of the recalled sleep apnea machines and was subsequently diagnosed with pulmonary fibrosis, other respiratory health problems, or cancer may be able to file a lawsuit against Philips and receive financial compensation.  Claims have been consolidated into an MDL Class Action in Pennsylvania.

Elmiron

Elmiron (Pentosan polysulfate) is a medication used for the treatment of bladder pain or interstitial cystitis. Studies have recently linked use of Elmiron to the development of macular eye damage. If you have recently suffered vision loss, pigmentary maculopathy, toxic maculopathy, or other eye conditions due to the use of Elmiron you may be able to receive financial compensation from the prescription manufacturer.  Claims against the prescription manufacturer have been consolidated into an MDL Class Action in New Jersey (more info).
